Time is of the essence and deadlines
are not forgiving in the 1031 process. It is paramount
that all players (including the buyer and seller), are on the
same page throughout the purchase and sale process.
The seller of the property being
purchased is the only party who has no direct benefit derived
from closing "on time".
A well documented time line and continuous on-going
communications is the order of the day.
The lender and escrow need to
work hand in hand and followup by phone is critical.
Mortgage payoff procedures and underwriting issues need to be
addressed early in the purchase and sale process.
The 1031 seller and subsequent
purchaser needs to have already established a relationship with
the "intermediary" before advertising a "1031" listing for sale.
Why? Because the intermediary will go over the entire 1031
(including the subsequent purchase) BEFORE the process even
begins.
Bottom Line:
The RE Agent, the lender, the escrow
officer, and the intermediary are all a "team of players" that have a
mutual interest in serving the "best interests" of a
"mutual client".
As in sports, "the team" that
practices together, learns together, also wins together ---
Doesn't
it make sense to use a "team that is familiar with each others
process and knows their every move?" Of course!
